General Terms and Conditions

1. Scope of application

  • For the business relations between Salt'n Becker e.U. ("Salt'n Becker") and the consumer pursuant to § 1 KSchG ("Customer"), these General Terms and Conditions ("GTC") shall apply exclusively in the version valid on the day of the order, unless otherwise agreed. Deviating terms and conditions of the Customer shall not be recognized unless Salt'n Becker expressly agrees to other terms and conditions.
     
  •  The GTC apply to any use of this website (saltnbecker.com), in particular any sale and delivery of goods by Salt'n Becker to the customer.
     
  • Customers are consumers in the sense of the Consumer Protection Act (KSchG) and thus natural or legal persons who are not entrepreneurs.
     
  • "Goods" mean all products and coupons offered for sale on the Site.
     
  • "Pre-Order Goods" are products offered for sale on the Website which are custom-made products and are specifically marked "Pre-Order Goods".

2. Contractual partner

  • The purchase contract is concluded with Salt'n Becker e.U., Arsenal 5/5/14, 1030 Vienna.
     
  • Salt'n Becker is available for questions, complaints and claims on weekdays from 10:00 to 18:00 under the telephone number +43 670 604 6085 and by email at info@saltnbecker.com.

3. Offer and conclusion of contract

  • The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to order.
     
  • By clicking the "Pay now" button, the customer places a legally binding order for the goods listed on the order page.
     
  • Only upon Salt'n Becker's acceptance of the order shall a purchase contract come into existence and thus the Customer's claim to delivery. The acceptance by Salt'n Becker shall be made by means of an order confirmation by email ("Order Confirmation"). The Customer shall ensure that the email address provided by him for order processing is complete and correct.

4. Order process

  • The customer can add single or multiple items to the virtual shopping cart on the respective page of the offered goods of the online store by clicking the button "Add to cart" or a corresponding graphic symbol goods. After placing all the desired items in the shopping cart, the customer can start the ordering process by clicking the button "Checkout" or by the corresponding graphic icon.
     
  • Orders are possible for both registered and guest customers. An order is only possible if the registered customer or the guest customer has filled in all mandatory fields in the order form. In case of missing information or if the order is not feasible for other reasons, the customer will receive an error message.

    The customer receives supporting detailed information in each case at the required place in the course of the ordering process. In the last step of the ordering process, the customer is shown an overview of the products he has selected as well as the other information he has provided (address, payment method, etc.).

    Before clicking on the "Pay now" button, the customer confirms that he/she has read and agrees to the General Terms and Conditions by ticking the appropriate box.

    The Customer shall then be notified by email of the receipt of the order by Salt'n Becker. This confirmation of receipt is for information purposes only and does not constitute an order confirmation.
     
  • In the case of pre-order goods, Salt'n Becker is happy to respond to the individual wishes of the customer. If the customer has any questions regarding the respective product or the order process, he/she is welcome to contact Salt'n Becker directly at coats@saltnbecker.com. It is pointed out to the deviating conditions for pre-order goods (longer delivery times point, exclusion from exchange, see point 8.).
     
  • After completing the order, their order data is no longer accessible via the Internet for security reasons. Registered customers can view their orders already placed in the protected customer area.

5. Prices

  • The prices stated on the product pages are gross sales prices and include statutory VAT (calculated on the basis of Austrian VAT) and other price components, but not shipping costs.
     
  • Gift Vouchers:
    The following provisions apply to the sale of vouchers:
    • Vouchers have a validity period of 24 months from the date of purchase.
    • Vouchers are non-transferable and cannot be returned or paid out.
    • If the total value of an order is less than the value of the voucher, the excess amount will be issued and sent with a new voucher.
    • If items paid for using a voucher are returned, the amount to be refunded will be issued and sent with a new voucher.
    • Salt'n Becker assumes no responsibility for lost, stolen, destroyed or unauthorized redemption of vouchers.
    • Discount codes cannot be applied to the purchase of gift certificates.

6. Shipping costs and delivery

  • The shipping costs can be found in the item "Shipping overview" on the website. The shipping costs will be communicated to the customer during the ordering process. It should be noted that when shipping to non-EU countries, any import sales taxes and any customs duties are to be borne by the customer (= recipient). These costs cannot be estimated by Salt'n Becker. The customer must contact the responsible customs authority in this regard.
     
  • The processing and delivery of the ordered goods is subject to availability. The processing time of the order by Salt'n Becker is generally between 1 and 3 business days for goods and between 3 and 12 weeks for pre-order goods. Any deviating processing times will be indicated on the respective product page. The delivery time indicated by the shipping company can also be taken from the item "Shipping overview" on the website and is usually between 3 and 5 working days (standard delivery time of the shipping company).

7. Cancellation policy

  • Right of withdrawal
    The customer has the right to revoke this contract within 14 days without giving any reason. The revocation period is 14 days from the day on which the customer or a third party named by the customer, who is not the carrier, has or has taken possession of the goods.

    In order to exercise the right of withdrawal, the customer must inform us (Salt'n Becker e.U., Arsenal 5/5/14, 1030 Vienna / Austria, Tel +43 670 604 6085, Email info@saltnbecker.com) by means of a clear declaration (e.g. a letter or email sent by post) of his decision to withdraw from this contract.
    In order to comply with the withdrawal period, it is sufficient that the customer sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
     
  • Consequences of withdrawal
    If the Customer revokes this Agreement, Salt'n Becker shall repay to the Customer all payments Salt'n Becker has received from the Customer, including delivery costs (with the exception of additional costs resulting from the fact that the Customer has chosen a type of delivery other than the cheapest standard delivery offered by Salt'n Becker), without undue delay and no later than within 14 days from the receipt of the returned goods by Salt'n Becker. For this repayment, Salt'n Becker shall use the same means of payment that the Customer used for the original transaction, unless expressly agreed otherwise with the Customer; in no case shall the Customer be charged any fees due to this repayment. Salt'n Becker may in any case refuse repayment until Salt'n Becker has received the goods back or until Customer has provided proof that he has returned the goods, whichever is the earlier.

    The Customer shall return or hand over the goods to Salt'n Becker without undue delay and in any case no later than within 14 days from the day on which the Customer notifies Salt'n Becker of the withdrawal from this contract. The deadline shall be deemed to have been met if the Customer sends off the goods before the expiry of the 14-day period.

    The customer bears the direct costs of the return.

    The customer shall only be liable for any loss in value of the goods if this loss in value is due to handling by the customer (e.g. use by the customer) that is not necessary for testing the condition, properties and functioning of the goods.
     
  • The right of withdrawal does not apply to goods that are manufactured according to customer specifications, that are clearly tailored to personal needs or that are not suitable for return due to their nature (§ 18 para. 1 FAGG). Therefore, there is no right of withdrawal for pre-order goods.

8. Returns

  • If the Customer is making use of its right of withdrawal or wishes to exchange the goods within 14 days of receipt and returns the goods to Salt'n Becker, the Customer has to bear the direct costs of the return shipment.

    The return shipment must be addressed in due time to the following address:

    Any customs costs incurred for delivery and return from non-EU countries will not be borne by Salt'n Becker. In this case, the amount of any customs costs incurred will be deducted from the refund amount.

    The customer must return the goods only in unused, unwashed condition and provided with all labels and other enclosed garment bags, hangers or dust bags, etc., and when returning the goods, also return the original packaging.
     
  • Pre-order goods purchased in Salt'n Becker's online store are excluded from the right of return/exchange.

9. Payment methods

  • Salt´n Becker accepts the following payment methods:
     
    • Instant bank transfer / Online bank transfer (Paypal, Shop Pay, Google Pay, Klarna)

      The processing of payment by instant transfer / online transfer is carried out via the service providers Klarna, Shop Pay, Google Pay or Paypal. The contractual relationship between Klarna, Shop Pay, Google Pay or PayPal on the one hand and the customers on the other hand are governed exclusively by the respective terms of use of Klarna, Shop Pay, Google Pay or PayPal.
       
    • Credit card (VISA, Mastercard, American Express)

      Payment by credit card is processed via the service provider Shopify Payments. The contractual relationship between Shopify Payments and the customer is governed exclusively by the terms of use of Shopify Payments.
       
    • Payment by invoice (Klarna)

      In cooperation with Klarna, Salt'n Becker offers customers the purchase on account as a payment option. The contractual relationship between Klarna and the customers is governed exclusively by the terms of use of Klarna.

      The payment period for Klarna invoice is 14 days from the invoice date. The customer receives the invoice including order confirmation after conclusion of the purchase contract from Salt'n Becker via email. The online store does not charge any service fee when purchasing on account with Klarna.
       
  • Salt Salt'n Becker reserves the right not to offer certain payment methods and to refer to other payment methods for each order.
     
  • The customer agrees that invoices will be created electronically and sent to him/her by email.
     
  • The delivery of the order takes place with the payment method immediate transfer / online transfer only after receipt of the purchase price plus shipping costs on the account of Salt'n Becker. In the case of payment by credit card, the Customer's credit card account shall be debited upon dispatch of the order to the Customer.
     
  • Salt'n Becker shall be entitled to charge default interest at the rate of 5% p.a. from the first day of default. Salt'n Becker reserves the right to claim further damage caused by default.

10. Retention of title

  • The goods remain the property of Salt'n Becker until payment has been made in full.
     
  • In the event of default of payment by the Customer, Salt'n Becker shall be entitled to assert its rights under the retention of title. It is agreed that the assertion of the reservation of title shall not constitute a rescission of the contract unless Salt'n Becker expressly declares the rescission of the contract."

11. Warranty and liability

  • The provisions on the statutory warranty shall apply. The warranty period for the delivery of movable goods is two years from the date of acceptance of the goods.

  • Claims for damages by the Customer against Salt'n Becker in cases of slight negligence shall be excluded; this shall not apply to personal injury.
     
  • The photographs used by Salt'n Becker to advertise products are product images that do not necessarily show the appearance of a product in everyday use. Salt'n Becker shall therefore not be liable for ensuring that products correspond exactly to the photographs used for advertising.

12. Image rights

  • Salt'n Becker reserves all rights, in particular image, trademark and copyright, to the content of the website and the online store. Any use of images, even in part, is not permitted without the consent of Salt'n Becker.

13. Data protection

  • The protection of personal data has a high priority for Salt'n Becker. Salt'n Becker complies with the provisions and requirements of the General Data Protection Regulation (DSGVO) and the Austrian Data Protection Act (DSG). More details on data protection can be found in the privacy policy.

14. Alternative dispute resolution informationen

  • In disputes arising from paid online purchase or service contracts, consumers can turn to the online dispute resolution platform in accordance with ODR Regulation No. 524/2013: http://ec.europa.eu/consumers/odr/.
     
  • Salt'n Becker shall endeavor to settle any disagreements arising from the Contract with the Customer amicably. The Customer may therefore also submit its complaint directly to Salt'n Becker at the following e-mail address: info@saltnbecker.com.

15. Final clauses

  • All amendments and additions to the contract with the customer, including these GTC, must be made in writing to be valid.
     
  • The customer can view these GTC at www.saltnbecker.com. In addition, the customer can print or save this document using the usual function of the Internet utility (=browser: there usually "File" -> "Save as").
     
  • Austrian law shall apply to this contract. Contractual language is German.
     
  • For all actions brought against a customer who has his domicile, habitual residence or place of employment in Austria due to disputes arising from this contract, one of the courts in whose jurisdiction the customer has his domicile, habitual residence or place of employment shall have jurisdiction. For customers who are not domiciled in Austria at the time of the conclusion of the contract, the statutory places of jurisdiction shall apply.
     
  • Should individual provisions of the contract with the customers, including these GTC, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The contracting parties shall replace the invalid provisions with a valid and enforceable provision that comes as close as possible to the invalid provision in terms of its content and purpose.
